Welcome to Mediva.io (hereinafter referred to as “the Company” or “the Website”). By using this Website, you are deemed to have agreed to the following Terms of Service. Please read these Terms carefully before using the Website.
1. Company Information and Governing Law
The Company is duly incorporated under the laws of the Hong Kong Special Administrative Region and complies with all relevant Hong Kong regulations. Any legal disputes related to this Website shall be governed by Hong Kong law, with the courts of Hong Kong having exclusive jurisdiction.
2. Nature of Services
The Company operates as a cross-border e-commerce service platform, assisting users in connecting with overseas pharmaceutical manufacturers (primarily in Bangladesh). Services provided include a localized multilingual interface, purchase support, order transmission, and payment coordination.
All pharmaceutical transactions are established directly between the user and the manufacturer. The Company is not the seller or importer of pharmaceuticals and does not participate in the manufacture, customs declaration, warehousing, or delivery of any products.
To avoid doubt, all medications are manufactured, fulfilled, and dispatched exclusively by overseas manufacturers, who ship directly to the user via international courier services such as DHL. No pharmaceutical products are stored, handled, repackaged, or delivered within Hong Kong by the Company, nor does the Company act as a pharmacy, wholesaler, distributor, or supplier as defined under Hong Kong’s Pharmacy and Poisons Ordinance (Cap. 138).
The Company’s role is limited to providing a multilingual ordering interface, facilitating communication, processing payments as authorized by users, and offering logistical tracking assistance.
3. Compliance and User Responsibilities
This platform only supports “personal import of small quantities of pharmaceuticals for individual use” in jurisdictions where such conduct is legally permitted.
Users acknowledge that they themselves are the importers of record in their respective jurisdictions and must ensure compliance with applicable laws regarding personal-use importation. All related legal risks—including seizure, return, fines, or customs actions—shall be borne solely by the user.
The Company does not advise on the legality of personal importation in any jurisdiction and shall not be held responsible for regulatory outcomes or customs determinations.
4. Product Information and Liability
All pharmaceutical information on the Website (including images, usage, ingredients, etc.) is provided by the manufacturer. The Company does not guarantee the completeness or accuracy of such information.
Users must consult qualified healthcare professionals for any matters related to medication. The Company does not provide medical advice.
In case of disputes relating to product quality, efficacy, or packaging, users must contact the manufacturer directly. The Company assumes no liability.
5. Medical Disclaimer
The content provided on this Website is for general informational and educational purposes only and does not constitute medical diagnosis or prescription advice. Users must consult a licensed physician before using any pharmaceutical. The Company accepts no liability for damages arising from misuse of information or delayed medical treatment.
6. Shipping Policy
Upon completion of an order and payment, the Company shall process the order within seven (7) business days and coordinate with the manufacturer to dispatch the goods via DHL air courier. Under normal circumstances, goods may arrive within seven (7) business days after shipment; however, actual delivery times may be affected by customs clearance, flight schedules, or logistics disruptions, and the Company makes no guarantee of delivery time.
In the event of delays, returns, or losses arising from customs clearance, transportation, or other logistics issues, liability rests with the logistics provider. Users must file claims directly with DHL or the relevant carrier. The Company may, at its discretion, assist in communication but bears no responsibility for refunds or compensation.
7. Refund and Return Policy
Due to the special nature of pharmaceuticals, once shipped, orders are non-refundable and non-returnable. Unless expressly stated otherwise, all shipped orders are deemed final and users may not request cancellations or returns.
If a user has completed payment but the manufacturer has not yet shipped the order, the Company may assist in arranging a full refund. Refund requests shall only be valid upon confirmation by the Company and notification to the manufacturer. Refunds will be processed using the user’s original payment method and are expected to be completed within fourteen (14) business days; however, the actual crediting time depends on banking or payment platform operations, for which the Company is not responsible.
8. Age Restrictions
This platform is intended solely for individuals aged 18 years or older. Minors must be accompanied by a legal guardian, and the Company bears no responsibility for their actions.
9. Intellectual Property and Third-Party Content
Some content on this Website is provided or licensed by manufacturers, and all related intellectual property rights belong to the original rights holders.
If you believe any content on this Website infringes your rights, please contact us and we will handle the matter promptly.
The Company does not guarantee the accuracy or legality of third-party content.
10. Platform Role and Limitation of Liability
The Company does not manufacture, sell, supply, or hold ownership of any pharmaceuticals. The Company only provides a purchase interface, informational intermediation, and payment facilitation services, and charges service fees accordingly.
Users acknowledge and agree that all products are shipped directly from overseas manufacturers and the Company does not take possession of the products at any stage of the transaction.
By using this Website, users expressly acknowledge that the Company is not a pharmacy, pharmaceutical supplier, drug wholesaler, distributor, or importer, and does not conduct any regulated pharmaceutical activities within Hong Kong.
All liabilities related to the manufacture, packaging, shipping, customs handling, or quality of pharmaceuticals rest solely with the manufacturer and logistics provider.
11. Amendments to Terms
The Company reserves the right to amend these Terms at any time. Updated Terms will be announced on the Website and shall take effect immediately upon posting. Users are advised to review the Terms regularly to stay informed of the latest updates.
